Terms and Conditions for All Out Adventure Rentals LLC

1. Introduction
Welcome to All Out Adventure Rentals LLC! By using our services to rent UTVs, motorcycles, mopeds, electric bicycles, hollywood racks for electric bicycles, and motorcycle gear (including: helmets, gloves, jackets), you agree to comply with these Terms and Conditions. Please read them carefully before making any reservations or rentals.

2. Definitions
- “Renter” or “You”: The individual or entity who agrees to rent the equipment from All Out Adventure Rentals LLC.
- “Rental Equipment”: The item, equipment, property, or service being rented to the Renter.
- “Reservation”: The process by which the Renter secures the rental equipment for a specified period.
- “Rental Period”: The duration for which the rental equipment is rented to the Renter.
- “Card on File”: A credit or debit card in the Renter’s full name to cover any damages or loss to the rental equipment.
- “Late Fee”: A charge imposed on the Renter for returning the rental equipment later than agreed.
3. Rental Agreement
3.1 Reservation Process
To reserve rental equipment, the Renter must complete the reservation process via our website alloutadventurerentals.com, calling 865-252-3622, or in-person at our store location. A valid payment method is required to complete the reservation.
3.2 Rental Period
The Rental Period will be specified in the reservation confirmation and begins on the agreed start date and ends on the agreed end date. The Renter must return the equipment by the specified return date unless otherwise agreed upon in writing.
3.3 Rental Fees
The Renter agrees to pay the full rental amount as outlined at the time of reservation. This includes:

- Tennessee State Tax, 7%
- Local Tax, 2.75%
- Stripe Processing Fee, 2%
3.4 Payment Terms
Full payment is required when completing your reservation. Payments can be made online or in-person via Booqable with a credit or debit card. Payment is due at the time of reservation. If payment is not received, your reservation will not be confirmed.
3.5 Security and Damages
All Out Adventure Rentals LLC does not collect a security deposit at the time of rental. However, a card on file with a valid credit or debit card is required and will be securely stored on file for the duration of your rental period. By renting our equipment, the Renter authorizes All Out Adventure Rentals LLC to charge the Renter’s card on file for any damages, loss, fuel, or excessive cleaning costs resulting from your rental, as outlined in our waiver and liability forms. The Renter will be notified and provided with documentation of any such charges prior to billing.
4. Customer Responsibilities
4.1 Use of Rental Equipment
The Renter agrees to use the rental equipment solely for its intended purpose and in accordance with all applicable laws. The Renter agrees not to:
- -Sublet or transfer the rental property to any third party.
- -Use the rental property in a manner that could cause damage, harm, or injury.
4.2 Care of Rental Equipment
The Renter agrees to return the rental equipment in the same condition as received, excluding normal wear and tear. The Renter is responsible for any damage, loss, or theft that occurs during the rental period.
4.3 Pet Policy
Pets are welcome on our UTVs only. Please note the following requirements and conditions:
- –All pets must be properly secured during the rental. Renters are responsible for bringing their own pet transportation products, such as leashes, crates, carriers, blankets, or any other safety equipment.
- –All Out Adventure Rentals LLC does not provide any pet-related items, including but not limited to leashes, restraints, carriers, or protective coverings.
- -Renters are fully responsible for any damage caused by their pet, as well as any additional cleaning required due to pet hair, odor, stains, or accidents.
- -A cleaning or damage fee will apply if the vehicle is returned in unsatisfactory condition due to pet transport. The fee amount will vary based on the extent of the issue.
By transporting a pet on our UTVs, the Renter acknowledges and agrees to these conditions.
4.4 Insurance
Your rental with All Out Adventure Rentals adds you as an additional insured to their commercial automobile policy. This policy includes certain auto liability coverage, which, generally, may pay for bodily injury or property damage caused by an accident during your rental. The auto liability coverage is subject to the actual terms, conditions, exclusions, and limits of liability of the policy. 4.5 Prohibited Use Clause
The Renter agrees not to use the rental equipment in any of the following ways:
- -While under the influence of alcohol, drugs, or any substance that impairs judgment or ability.
- -In violation of local, state, or federal laws, including but not limited to traffic laws and safety regulations.
- -For racing, stunt driving, reckless behavior, or any similar high-risk activity.
- -On unauthorized terrain, private property without permission, closed trails, or areas specifically marked as restricted.
- -To transport illegal goods, weapons, or hazardous materials.
- -To carry more passengers than the equipment is designed for, or in a manner not intended by the manufacturer.
- -By anyone not listed as an authorized driver/rider on the rental agreement.
Any violation of these terms may result in immediate termination of the rental agreement, forfeiture of any rental fees, and potential legal or financial liability for damages or injury.
4.6 Age Requirements
Renters must be at least 21 years old to rent and operate UTVs, motorcycles, and mopeds. To operate an electric bicycle, renters must be at least 16 years old and accompanied by a parent or legal guardian who is also renting.
A valid driver’s license is required for all renters at the time of pickup. All operators of rental vehicles must meet the minimum age and licensing requirements, as applicable by vehicle type.
4.7 Safety Equipment
All renters are required to wear appropriate safety gear, including helmets and closed-toe shoes, while operating motorcycles, mopeds, or electric bicycles.
- –Included Gear: Helmets and safety vests are provided at no additional charge with all electric bicycle rentals.
- –Optional Gear for Renters: Helmets, jackets, and gloves for motorcycles and mopeds are available to rent for $10 per item, per day.
If a renter does not provide their own DOT-approved helmet, they will be required to rent one from All Out Adventure Rentals LLC. Failure to wear safety gear (e.g. helmet and closed-toe shoes) is at the renter’s own risk and may impact insurance coverage or liability in the event of an accident.
4.8 Car Seat Policy
If you will be traveling with a child who requires a car seat, you are responsible for providing and properly installing an appropriate seat. Our rental units are generally better suited for booster seats due to limited interior space, especially for rear-facing car seats. Because fitment varies by seat model, we cannot guarantee that your car seat will fit in our vehicles.
We recommend visiting our location in advance to test fit your car seat prior to booking. All Out Adventure Rentals assumes no responsibility or liability for the use, installation, or performance of any child safety seat.
Please note that no refunds will be issued due to car seat fitment issues or related concerns.
5. Cancellations and Modifications
5.1 Cancellation Policy
The Renter may cancel the reservation up to 48 hours before the rental period begins for a full refund. Cancellations within 48 hours will not be issued a refund. Cancellations cannot be done online, the Renter must call 865-252-3622 in order to cancel their reservation.
5.2 Grace Period and No Show Policy
All Out Adventure Rentals LLC offers a 2-hour grace period from the scheduled pickup time. During this grace period, the Renter may still collect their rental without penalty; however, the original drop-off time remains unchanged.
Please note:
- –No refunds will be issued for late pickups.
-If the Renter fails to arrive or contact All Out Adventure Rentals LLC within 2 hours of the scheduled pickup time, the reservation will be considered a no-show and will be automatically canceled without refund.
5.3 Modifications
Requests to modify the rental period (e.g., changing dates or extending the rental) must be made at least 24 hours in advance. Modifications are subject to availability and may incur additional charges and fees.
5.4 Weather and Rain Policy
All Out Adventure Rentals LLC operates rain or shine, as weather conditions in the Smoky Mountains are highly unpredictable and can change rapidly.
In the event of rain, rescheduling may be offered at the sole discretion of All Out Adventure Rentals LLC and is subject to availability. We will make reasonable efforts to accommodate reschedule requests; however, rescheduling is not guaranteed.
Refunds will not be issued due to rain or other weather conditions unless All Out Adventure Rentals LLC deems it unsafe to operate. In such cases, a refund or reschedule may be offered at our discretion.
Customers are encouraged to monitor the weather and plan accordingly. Proper attire and preparation are recommended for varying conditions.
6. Late Returns
6.1 Late Fee
If the rental equipment is not returned by the specified end of the Rental Period, the Renter will incur a late fee of $50 for every 30 minutes that the equipment is overdue. Failure to return the equipment within 2 hours after the specified Rental Period without contacting All Out Adventure Rentals LLC, may result in further action, including legal action, charging for the full value of the equipment, and reporting the item as stolen to local authorities.
7. Liability and Indemnity
7.1 Limitation of Liability
All Out Adventure Rentals LLC is not liable for any injury, damage, or loss caused by the use of the rental property. The Renter agrees to use the rental equipment at their own risk and assumes full responsibility for any consequences of its use.
7.2 Indemnification
The Renter agrees to indemnify and hold harmless All Out Adventure Rentals LLC, its employees, and agents from any claims, damages, or expenses arising out of the Renter’s use of the rental property and equipment.
8. Rental Equipment Condition
8.1 Inspection
The Renter agrees to inspect the rental equipment upon receipt and report any pre-existing damage or issues within 1 hour. Failure to do so will result in the Renter being responsible for any damages that occur during the rental period.
8.2 Return Condition
The Renter agrees to return the rental equipment in the same condition as received, except for normal wear and tear. Cleaning fees may apply if the equipment is not returned in a clean condition. An excessive cleaning fee of $75 fee may be charged for excessive mud, trash, or neglect.
8.3 Fuel Requirement
The Renter agrees to return all UTVs, motorcycles, and mopeds with the same fuel level as when rented- a full tank unless otherwise noted. Renter agrees to provide a valid fuel receipt, dated the same day or the day prior to return, as proof of refueling. If the vehicle is returned without being refueled, or without a receipt, the Renter will be charged the total cost of refueling, plus a $50 inconvenience fee. This fee covers the time and logistics involved in refueling the vehicle on the Renter’s behalf. This policy applies to UTVs, motorcycles, and mopeds only. Electric bicycles are excluded from the fuel requirement. All equipment is required to be fueled with Premium 93 octane fuel.
By renting from All Out Adventure Rentals LLC, you acknowledge and agree to this fuel policy and authorize us to apply any applicable charges to your card on file.
9. Termination of Agreement
9.1 Early Termination
Both the Renter and All Out Adventure Rentals LLC may terminate the rental agreement early for any valid reason. If the Renter terminates within 48 hours of rental period, no refund will be given unless otherwise specified.
9.2 Default
If the Renter fails to comply with any of these Terms and Conditions, All Out Adventure Rentals LLC may terminate the agreement and retain any amounts paid.
10. Force Majeure
All Out Adventure Rentals LLC will not be held liable for failure to perform under this agreement in the event of unforeseen circumstances beyond our control, including but not limited to natural disasters, pandemics, acts of war, or other emergencies.
11. Privacy and Data Protection
We take your privacy seriously. Your personal data will only be used for the purpose of fulfilling your rental agreement and will not be shared with third parties unless required for payment processing through Stripe or other essential services. For more details, please refer to our Privacy Policy.
12. Dispute Resolution
12.1 Governing Law
These Terms and Conditions are governed by the laws of the State of Tennessee.
12.2 Mediation/Arbitration
In the event of a dispute, both parties agree to attempt to resolve the issue through mediation before seeking legal action.
13. Amendments to the Terms
All Out Adventure Rentals LLC reserves the right to amend these Terms and Conditions at any time. Any changes will be communicated to the Renter via email or posted on our website.
14. Photo/Video Documentation Clause
All Out Adventure Rentals LLC will take photos or videos of the rental equipment before and after the rental period for documentation and damage assessment purposes.
15. Miscellaneous
15.1 Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
15.2 Entire Agreement
These Terms and Conditions constitute the entire agreement between the parties and supersede any prior agreements, written or oral.
By renting with All Out Adventure Rentals LLC, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
